This research is motivated by the practice of broadcasting songs by radio stations in Palu City, which is carried out without obtaining a license and without paying royalties to the creators. This is caused by promotional cooperation between radio stations and music labels, where songs are sent by the labels to be played on the radio as a form of promotion. This practice raises legal issues, considering that positive legal provisions in Indonesia, especially those related to Copyright, explicitly require that any form of song utilization, including radio broadcasting, must be carried out based on permission or a license and accompanied by royalty payments. The purpose of this study is to analyze the legal protection of copyright in the broadcasting of songs by radio stations, as well as to examine whether promotional cooperation between music labels and radio stations can serve as a legal basis for exemption from this obligation. The method used is an empirical juridical approach with data collection techniques through interviews with broadcasting industry players in Palu City. The research results indicate that legal protection of copyright for song broadcasting by radio stations in Palu City has not been implemented optimally. This is based on the fact that the acquisition of songs for broadcasting purposes, both by RRI Palu radio station and Nebula Radio, Radio Ramayana, and Radio Al-Khairat Palu, has not been accompanied by license ownership and the fulfillment of royalty payment obligations for the songs broadcasted. As for promotional cooperation between music labels and radio stations, it has so far been informal and cannot be used as a reason to waive the obligation to pay royalties and obtain licenses.
