PERLINDUNGAN HUKUM TERHADAP PIHAK YANG DIRUGIKAN DALAM PERALIHAN HAK ATAS TANAH MELALUI JUAL BELI PADA PUTUSAN NOMOR 116/PDT.G/2023/PN PAL

ABSTRAK
Rumusan masalah dalam penelitian ini adalah:
1) Bagaimana perlindungan hukum bagi pihak yang dirugikan dalam peralihan hak atas tanah melalui jual beli pada Putusan Nomor 116/Pdt.G/2023/PN Pal?
2) Bagaimanakah pertimbangan hakim terhadap pihak yang dirugikan dalam peralihan hak atas tanah melalui jual beli pada Putusan Nomor 116/Pdt.G/2023/PN Pal?
Tujuan penulisan ini adalah untuk mengetahui perlindungan hukum bagi pihak yang dirugikan dalam peralihan hak atas tanah melalui jual beli pada Putusan Nomor 116/Pdt.G/2023/PN Pal serta untuk mengetahui pertimbangan hakim terhadap pihak yang dirugikan dalam peralihan hak atas tanah melalui jual beli pada putusan tersebut.
Jenis penelitian yang digunakan adalah penelitian hukum normatif. Kesimpulan penulis menunjukkan bahwa perlindungan hukum bagi pihak yang dirugikan dalam peralihan hak atas tanah melalui jual beli pada Putusan Nomor 116/Pdt.G/2023/PN Pal adalah Bapak Budi Utomo selaku Penggugat. Sejak terjadinya transaksi jual beli, Penggugat belum sempat melakukan proses balik nama sertifikat di Kantor Badan Pertanahan Kota Palu. Ketika Penggugat hendak melakukan proses balik nama sertifikat tersebut, Tergugat sudah tidak lagi bertempat tinggal di alamat terakhirnya, termasuk ahli warisnya.
Menurut kesimpulan penulis, jual beli antara Penggugat dan Tergugat dinyatakan sah dan mempunyai kekuatan hukum mengikat, serta Penggugat berhak untuk melakukan balik nama sebagaimana telah dipertimbangkan oleh hakim. Hal tersebut sesuai dengan Pasal 1457 KUHPerdata yang menyatakan bahwa jual beli adalah suatu persetujuan di mana pihak yang satu mengikatkan dirinya untuk menyerahkan suatu barang dan pihak yang lain untuk membayar harga yang telah dijanjikan.
Pertimbangan hakim terhadap pihak yang dirugikan dalam peralihan hak atas tanah melalui jual beli pada Putusan Nomor 116/Pdt.G/2023/PN Pal adalah mengabulkan gugatan Penggugat seluruhnya dengan verstek.

ABSTRACT
This study aims to examine the judge’s considerations in protecting the aggrieved party in the case and to analyze the forms of legal protection afforded to the injured party in a land rights transfer through sale and purchase, as reflected in Decision Number 116/Pdt.G/2023/PN Pal. The methodology employed is normative legal research. Based on the findings, Mr. Budi Utomo was granted legal protection as the plaintiff in Decision Number 116/Pdt.G/2023/PN Pal concerning the transfer of land rights through sale and purchase to the disadvantaged party. The plaintiff had not been able to complete the administrative process of changing the name on the land certificate at the Palu City Land Office since the sale and purchase transaction took place. When attempting to process the transfer, the plaintiff was unable to locate the defendant and the defendant’s heirs at their former address. Despite efforts to ascertain their whereabouts, these attempts were unsuccessful. As an administrative requirement mandated by the co-defendant, the certificate transfer procedure formally required the name of the original owner, William Laoh, or his heirs. Consequently, the plaintiff was unable to carry out the administrative transfer of ownership of the disputed land and could not fully exercise his rights over the land. In conclusion, the sale and purchase agreement between the plaintiff and the defendant was deemed legally valid and binding in this case. Therefore, the court’s decision took into account the plaintiff’s right to proceed with the name change procedure.
